After more than five years, the proceedings are now over. Following three major court hearings, starting with the High Court trial we thought we had won convincingly back in 2017, we are relieved that we do not have to endure the stress of a full retrial ordered through no fault of our own.
The discontinuation of the proceedings means that we are now at last free to continue the important work of Nowy Czas without the worry of this case hanging over us. We have not incurred or admitted any liability to Mr Serafin. We will not be publishing any retraction or apology in relation to our previous reporting about him, nor are we constrained in what we may publish in the future. It is a comprehensive victory for us personally, for Nowy Czas, and for free speech.
We could not have secured this outcome without your support. As soon as it became clear that there was significant support for our crowdfunding efforts, we were able to pay for the services of a well-regarded barrister, a specialist in media law. He began the detailed preparation of our case, and also gave us crucial support in our correspondence with the claimant’s lawyers. We believe that it was this development – only made possible thanks to your support – that finally convinced the claimant to give up his case against us.
We are so grateful to everyone who stood up for our right to free speech. We hope Nowy Czas will survive the effect of this long-lasting battle and will continue to serve our community as it has been doing for so many years.
